1. INTRODUCTION

This Platform Disclaimer ("Disclaimer") applies to all users of the Media Creative Hub platform, whether as creators, buyers, visitors, or in any other capacity. By accessing or using Media Creative Hub FZE ("Media Creative Hub," "we," "us," or "our") services, you agree to the terms of this Disclaimerm.

2. INTERMEDIARY STATUS

2.1: Media Creative Hub functions as an intermediary platform connecting content creators with buyers. We do not create, own, or control the content listed by creators on our platform.
2.2: As an intermediary, Media Creative Hub does not endorse any content uploaded by creators and makes no representations or warranties regarding the quality, accuracy, legality, or suitability of such content.

3. CONTENT RESPONSIBILITY

3.1: Sellers are solely responsible for the content they upload to the platform, including ensuring that such content:
  • • Does not infringe on any third-party intellectual property rights
  • • Complies with all applicable laws and regulations
  • • Functions as described and is fit for its intended purpose
3.2: Buyers are responsible for:
  • • Determining whether the content is suitable for their intended purpose
  • • Using the content in accordance with the applicable license terms
  • • Ensuring their use of the content complies with all applicable laws and regulations

4. NO WARRANTY

4.1: Media Creative Hub provides the platform and all content "as is" and "as available" without warranties of any kind, either express or implied.
4.2:We expressly disclaim all warranties, including but not limited to:
  • • Implied warranties of merchantability
  • • Fitness for a particular purpose
  • • Non-infringement
  • • Accuracy or completeness of content
  • • Uninterrupted or error-free service

4.3: While we strive to maintain a high-quality platform, we cannot guarantee that content will be free from errors, defects, malware, or other harmful components.

5. INTELLECTUAL PROPERTY CLAIMS

5.1: Media Creative Hub respects intellectual property rights and expects our users to do the same.
5.2:If you believe that content on our platform infringes your intellectual property rights, please submit a notice to [email protected] with the following information:
  • • Identification of the intellectual property allegedly infringed
  • • Identification of the content allegedly infringing
  • • Your contact information
  • • A statement of good faith belief that the use is not authorized
  • • A statement that the information is accurate and that you are the rights holder or authorized to act on their behalf

5.3: Upon receiving a valid notice, we will take appropriate action, which may include removing or disabling access to the content claimed to be infringing.

6. LIMITATION OF LIABILITY

6.1: To the maximum extent permitted by law, Media Creative Hub shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to:
  • • The use of or inability to use our platform
  • • Any content posted by creators
  • • Any transactions between creators and buyers
  • • Unauthorized access to or alteration of your data

6.2: Our total liability for all claims related to these Terms shall be limited to the greater of:
  • • The amount paid by you to Media Creative Hub during the six (6) months prior to the claim
  • • AED 1,000

7. INDEMNIFICATION

7.1: You agree to indemnify and hold harmless Media Creative Hub, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:
  • • Your use of the platform
  • • Your content (for creators)
  • • Your violation of these Terms
  • • Your violation of any rights of another person or entity

8. DISPUTE RESOLUTION

8.1: In the event of any dispute between creators and buyers, the parties agree to first attempt to resolve the dispute directly with each other.
8.2: If the parties cannot resolve the dispute, Media Creative Hub may, at its discretion, provide mediation services, but is under no obligation to do so.
8.3: Media Creative Hub reserves the right to make a final decision regarding any dispute related to our platform operations, including content removal, account suspension, or refund approvals.

9. CHANGES TO THIS DISCLAIMER

9.1: Media Creative Hub reserves the right to modify this Disclaimer at any time at our sole discretion.
9.2: Changes will be effective upon posting of the updated Disclaimer on the platform. We will provide notification of material changes through the platform or via email.
9.3: Your continued use of the platform after changes to the Disclaimer constitutes your acceptance of the revised terms.

10. GOVERNING LAW

10.1: This Disclaimer shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law principles.
10.2: Any legal action or proceeding arising under this Disclaimer shall be brought exclusively in the courts located in Sharjah, United Arab Emirates, and you hereby consent to the personal jurisdiction of such courts.

11. SEVERABILITY

11.1: If any provision of this Disclaimer is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.
